1. Acceptance of Terms

By accessing or using Zencia ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including owners and clients.

2. Description of Service

Zencia is a SaaS platform that enables users to create, manage, and deploy AI-powered voice agents. The Service includes:

  • AI voice agent creation and configuration
  • Conversational AI powered by third-party providers (ElevenLabs)
  • Phone number management and calling capabilities
  • Embeddable chat widgets for websites
  • Knowledge base management
  • Integration with third-party services (Twilio, Microsoft Outlook, Google Sheets)
  • Client portal for agency-style account management

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that client accounts created under your ownership comply with these Terms

4. Usage and Minutes

The Service operates on a minute-based billing model. You purchase minutes that are consumed when your AI voice agents handle conversations. Key points:

  • Minutes are shared across all agents under your account
  • Unused minutes do not expire unless your account is terminated
  • When your balance reaches zero, voice agents and phone services will be temporarily deactivated
  • Services are automatically restored upon purchasing additional minutes

5. Payments and Billing

Payments are processed through Razorpay. By making a purchase, you agree to:

  • Provide valid payment information
  • Authorize charges for purchased minutes
  • Accept that all payments are non-refundable unless otherwise required by law

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others through automated calls or messages
  • Make unsolicited robocalls or spam calls
  • Impersonate any person or entity without clear disclosure
  • Transmit malware, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any illegal telemarketing activities
  • Create agents that provide medical, legal, or financial advice without proper disclaimers

7. Intellectual Property

The Service, including its design, features, and branding, is owned by Zencia. You retain ownership of the content you create (prompts, knowledge base documents, agent configurations). We do not claim ownership over your data.

8. Third-Party Services

The Service integrates with third-party providers including ElevenLabs, Twilio, Google, and Microsoft. Your use of these integrations is also subject to their respective terms of service. We are not responsible for the availability or performance of third-party services.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination:

  • Your access to the Service will be revoked
  • Your agent configurations and data may be deleted
  • Remaining minutes are non-refundable

12. Limitation of Liability

To the maximum extent permitted by law, Zencia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
